These are the conditions that apply when you read or use this website. They are set out as questions and answers so that you can find the part you care about quickly. The privacy page describes what happens to information. This page covers everything else.
What do these terms cover?
These terms govern your use of this website. By opening it, reading it or using it in any way, you agree to them. If you do not agree, the right course is to stop using the site. They apply alongside our privacy policy, which sets out what becomes of information about the people we contact and the people who visit this site.
What is this website for?
This site describes Affinity Search Partners and the recruiting services we offer to employers: contract, contract-to-hire, permanent and leadership placements for technology and information systems roles. It is a description, not an offer. Nothing on the site is a proposal we are bound by, a quotation, or a commitment to take on a search. Any engagement between us and a client is governed by a signed written agreement between the parties. If that agreement and this site ever say different things, the agreement controls.
Why might we email you?
We may send business email to people whose work ties in with the services we offer. Anyone who receives such an email can end it by replying, in any words. The privacy page explains what we collect for that purpose, its sources, its retention and the ways to reach us.
Are the examples on this site real?
Any board, chart, checklist, list of steps or figure that appears here, or inside a sample we link to, is there to illustrate how work of this kind can look. Such material is sample data, not the result of any client engagement, and no promise about how any search will turn out.
What may you do with the site, and what may you not?
Use the site lawfully and for the purpose it was made for: learning who we are and what we do. Specifically, you agree that you will not:
- Disrupt or interfere with the site, or with the systems behind it.
- Attempt to reach areas of the site or its hosting that are not public.
- Look for weaknesses by probing, scanning or testing the site.
- Copy the site or its content by automated means, such as scraping or crawling for reuse.
Who owns the content?
The text, layout, logo and other content here are the property of Affinity Search Partners or of those who license material to us. Viewing the pages, and printing them for reference within your own business, is fine. Any other use, including reproducing the content elsewhere, needs our written permission. Rights in the work we perform for a client are set by the written agreement with that client, not by these terms.
What about links and outside services?
From this site you can reach our main website at affinitysearchpartners.com and the contact form there. The typeface on these pages comes from a third-party font service, which receives a request from your browser when a page opens. Each of those belongs to someone else and comes with its own terms and its own privacy practices, which govern your use of them. We are not responsible for their content or conduct.
Do we make any warranties about the site?
No. The site comes "as is", and it comes "as available". As far as the law permits, we make no warranties of any kind, express or implied, and that includes any implied warranty of merchantability, of fitness for any particular purpose, or of non-infringement. We give no assurance that the site will always be available, work without error, or be free of harmful components. Nothing here is professional advice, legal advice, financial advice or employment advice. For advice about your own situation, consult a qualified adviser.
How far does our liability go?
As far as the law permits, Affinity Search Partners has no liability for damages that are indirect or incidental, special or consequential, or punitive, nor for lost profits, lost revenue, lost data or lost business opportunities, whenever they arise from or connect with your use of the site or your inability to use it, and even if we were told such damages were possible. Our total liability to you for all claims relating to the site, taken together, is capped at one hundred US dollars. Not every jurisdiction permits every one of these limits. Where one is not permitted, it applies only as far as the law allows.
When would you have to cover our costs?
If you misuse the site or breach these terms, you agree to indemnify Affinity Search Partners and its owners, staff and agents against any claims, losses, liabilities and expenses that result, including reasonable attorneys' fees.
Which law applies, and how are disputes settled?
Tennessee law governs these terms and your use of the site, meaning the State of Tennessee's law, and any rule of that law about choosing another jurisdiction's law is set aside. Should a dispute arise out of these terms or the site, it goes to binding arbitration in Williamson County, Tennessee, conducted according to the American Arbitration Association's rules. This does not apply if the law forbids arbitration of a particular dispute; such a dispute may be brought before a court with jurisdiction over it.
What else should you know?
Should any provision here prove unenforceable, the remainder stands. Letting a breach pass once does not waive our right to act on a later one. These terms and the privacy policy together make up the whole agreement between us concerning this site. We may update the terms from time to time; the date at the top shows the version in effect, and continued use after a change means you accept the change.
